Judge’s Ruling

Judge Has Issued  Decision in Shew v. Malloy


The ruling issued by Judge Covello has favored the State of Connecticut. Our arguments were dismissed, and the judge accepted the States argument in the entirety. Read Decision and Order

Everyone would like to know what this means for CCDL and the other plaintiffs. Here is what we know as of now:

1) We are far from done! We knew that there would be appeals no matter how this ruling was decided, and we were prepared for this.
2) Judge Covello did acknowledge that the list of firearms that are deemed as assault weapons are very much in common use, but public safety outweighs a definitive right to such arms.
3) The legal team for CCDL and the other plaintiffs have already filed a ‘Notice of Appeal’ with the Federal Court System. Read Notice of Appeal here. Filing the appeal may take one to two weeks.

4) We are asking our members to be patient throughout this process. This will be a long fight, but it is a fight that we will not turn our backs on. The very foundation of the 2nd Amendment is at stake. Please contribute to the litigation fund.

April 5th we’re holding a rally at the Capitol. North side (Bushnell Park side). No firearms allowed in Bushnell Park, but they are allowed on the capitol grounds if lawfully carried.

We’re sure to get more publicity with the upcoming hearing.
Regardless of who wins in the Federal Court, the loser will appeal. Getting to the Supreme Court is the target.
Spring and Summer fundraising events are being planned.

Connecticut Sporting Arms has a donation jar on their counter and their customers have been good to us.

Oral arguments on our and sates Motions for Summary Judgement are January 30th at 1:30pm [Secretary’s Note: They’ve since been cancelled. Do not attend]
The case is fully briefed and all relevant documentation has been submitted by both sides.
There is no agreement on any of the facts between our side and the state except that the law was indeed passed.
The decision in New York can be an important indicator of how our case will go, but it doesn’t have to be.
There will be a significant amount of work to do at the 2nd Circuit when a decision has been reached in Federal District Court.

Judge is Preparing to Issue Decision Shew v.Malloy

After reviewing thousands of pages of documents from both the plaintiffs and the defendants, Judge Alfred Covello cancelled oral arguments. A decision may come within the next several days, but it may come later. We will inform CCDL members as soon as possible. The fact that the arguments have been canceled are in no way an indicator of how the Judge will rule. Whatever the outcome is, appeals will be filed by us or the State.

Full docket text for document 123: ORDER. After thorough review of the well-crafted and well-articulated position of the movants, and the responses thereto, the most recent of which was filed on January 15, 2014, the court concludes that oral argument on the pending motions is not necessary. The issues have been comprehensively briefed and the court is prepared to resolve the pending motions without further argument. The order setting the date for argument in this case is hereby vacated. The Oral arguments are set for 1/30/2014 at 1:00 PM in Courtroom One, 450 Main St., Hartford, at the federal courthouse before Judge Alfred Covello. The proceedings are open to the public.(If you want a seat in the courtroom, you will need to arrive early).

5th Anniversary Dinner

Come celebrate our anniversary at the 5th Annual CCDL dinner, to be held this year at the Aquaturf Club in Plantsville. Relax, enjoy a meal, and share a well deserved night out.

Over the last five years, we have watched our membership grow to 11,000 members, which has been an incredible show.

Price is $55 per person, and you must show your ticket at the door to gain entry. Your ticket will be used for a special door prize, a custom knife handcrafted by the CCDLs own Matt Gioia, with a handmade sheath. Bring some cash for both gun raffles and the bar.

Dinner will be buffet style, salad and cheese tables are on the menu as well. This event is 4-9pm, with dinner to start at 5:30. We will have some speakers, but not TOO many!
