Rather than find clear and convincing evidence, this bill is basically saying, ‘Better safe than sorry’. This should no be the standard in Connecticut. Oppose HB 5448. The Judiciary Committee,

I am writing in regards to HB 5448, HB 5432, HB 5390. An Act Concerning a Risk Protection Order or Warrant. This bill is nothing more than a mask over a gun grabbing agenda. There are current laws written making offenses with firearms illegal, as well as domestic violence offenses. Please make harsher penalties for offenders of our current Red Flag Laws and do not target law abiding citizens. Stripping people’s ability to defend themselves personally and legally is in direct contradiction to the very core of the legal and judicial process.

HB 5448 is based on the Giffords and Bloomberg red flag system, it allows people, including ex-girlfriends or ex-boyfriends to file for a risk warrant without a non-bias third party. Keep Connecticut’s requirement that a petition must be filed by two law enforcement officers, and they must have conducted an independent investigation.

HB 5448 is just another political attack on gun owners and the Second Amendment. Want to stop violent crimes? Go after the violent offenders. Address mental health, not intimidate gun owners from seeking mental health.

I am adamantly opposed to this expansion, and equally dramatic loss of rights proposed by HB 5448.

An actual abuser can use this to disarm their intended victim, and then following that, their intended and now disarmed potential victim has to prove by a “preponderance of evidence” they are really not the threat. Oppose this bill.
